Obtaining tax and VAT status extract in Netherlands

A Dutch tax and VAT status extract documents what the Belastingdienst and the KVK-linked VAT register hold on a legal entity at a given moment. Control over a Dutch company is exercised through its registered directors and its UBO filing. The extract establishes whether the entity is active, VAT-registered, and compliant with filing obligations — three facts that directly bear on who controls the operating entity and what a shareholder can enforce.

The extract does not interpret those facts. That distinction matters before payment is made.

Source: Belastingdienst taxpayer file · verified 2026-10-01 Access conditionThird-party access to the taxpayer file requires a declaration of legitimate interest; the BTW-nummer is publicly verifiable via VIES without registration. What it does not showOutstanding tax liabilities, audit status, or the identity of the beneficial owner. Those are held in separate registers under different access rules.

What the Dutch tax register contains

The Netherlands operates two parallel layers for tax identification. The RSIN (Rechtspersonen en Samenwerkingsverbanden Informatienummer) is assigned at incorporation and links the legal entity to the Belastingdienst. The BTW-nummer (VAT identification number) is issued separately and follows the format NL + nine digits + B + two digits.

Both numbers appear in the KVK Handelsregister extract. The Handelsregister is the primary public-facing source. It records the BTW-nummer alongside the registered address, directors, and legal form. The Belastingdienst taxpayer file is not public; it is accessible to the entity itself and, under defined conditions, to parties with a declared legitimate interest.

VIES — the EU-wide VAT Information Exchange System — confirms whether a BTW-nummer is valid and active. It returns a binary result for Netherlands: valid or invalid. It does not return the company name or address for NL registrations. An invalid result in VIES does not establish that the company does not exist; it establishes that the number is not active in the cross-border VAT system at the moment of the query.

What a tax status extract establishes for control purposes

The angle here is control: who operates the entity and what can a shareholder enforce. A tax status extract contributes three verifiable facts to that question.

Active status. An entity that is VAT-deregistered or has been struck from the Belastingdienst register is not conducting taxable activity. That is a material fact for any buyer assessing operational control.

Filing compliance. Gaps in VAT return filing indicate either dormancy or a compliance failure. Either condition affects the enforceability of contracts entered into during that period.

Registration continuity. The date of first VAT registration and any subsequent re-registrations establish whether the entity has operated continuously or has been reconstituted. Reconstitution can reset liability exposure.

None of these facts establishes the identity of the person who controls the entity in practice. That question is answered by the UBO register and the Handelsregister directors extract — separate documents, separate procedure.

Procedure and timeline

Obtaining a tax and VAT status extract for a Dutch entity involves three steps.

First, the BTW-nummer is verified against VIES. This step is instantaneous and free. It establishes active/inactive status in the cross-border VAT system only.

Second, the KVK Handelsregister extract is obtained. This document contains the RSIN, BTW-nummer, registered address, directors, and legal form. The KVK issues extracts on a per-document basis. The extract is timestamped at the moment of issuance.

Third, where filing compliance is required, a request is submitted to the Belastingdienst under the legitimate interest procedure. This step requires identification of the requesting party, a statement of purpose, and — in some cases — a power of attorney from the subject entity. The Belastingdienst processes such requests within a statutory period; the exact duration depends on the nature of the request and the completeness of the submission.

The total elapsed time from instruction to delivery of a complete extract package — VIES confirmation, KVK extract, and Belastingdienst compliance summary — is typically two to five business days for standard requests. Complex requests involving the legitimate interest procedure may take longer.

The limit of what the sources allow

The KVK Handelsregister and the Belastingdienst VAT register are the authoritative sources for Dutch tax and VAT status. Each has a defined ceiling.

KVK Handelsregister shows the BTW-nummer and RSIN as filed. It does not show whether VAT returns have been submitted, whether assessments are outstanding, or whether the entity is under audit. It shows the legal structure as registered, not the economic reality of control.

VIES returns a single binary: valid or invalid at the moment of query. It does not return filing history, liability position, or any data about the entity beyond the number itself.

Belastingdienst taxpayer file contains filing history and compliance data. Access by a third party requires a legitimate interest declaration. The Belastingdienst does not confirm outstanding liabilities to third parties under standard procedures. A clean filing record does not establish that no liability exists; it establishes that returns have been submitted on schedule.

UBO register. The Dutch UBO register (held at KVK) records beneficial owners with a 25 percent or greater interest. Following the CJEU judgment in C-37/20, public access to UBO data in the Netherlands is restricted. The UBO register is not part of a tax status extract. Establishing the identity of the person who controls the entity requires a separate procedure under different access rules.

The chain stops here. A tax and VAT status extract establishes registration, activity, and filing compliance. It does not establish who controls the entity, what liabilities are outstanding, or whether the entity is under investigation. Those questions require different sources, different procedures, and — in some cases — cannot be answered from public registers at all.

Where the sources disagree

Two situations produce source disagreement on Dutch tax status.

KVK active, VIES invalid. An entity can be registered and active in the KVK Handelsregister while its BTW-nummer returns invalid in VIES. This occurs when the entity conducts only domestic transactions and has not activated its intra-Community VAT number. It does not indicate deregistration or non-existence.

KVK active, Belastingdienst deregistered. An entity can remain on the KVK register after the Belastingdienst has deregistered it for VAT purposes. The KVK does not automatically reflect Belastingdienst deregistration. This discrepancy is a material fact: the entity exists legally but is not conducting taxable activity under VAT rules.

When these discrepancies appear, the extract records them explicitly. A discrepancy between sources is itself a result.

FAQ

Does a valid BTW-nummer confirm the company is operating? A valid BTW-nummer in VIES confirms the number is active in the cross-border VAT system at the moment of query. It does not confirm that the entity is trading, that returns are being filed, or that the entity has any current economic activity. Operational status requires the KVK extract and the Belastingdienst compliance check.

Can a third party obtain the Belastingdienst taxpayer file without the company's consent? Access by a third party requires a declaration of legitimate interest submitted to the Belastingdienst. The procedure is defined; the outcome depends on the nature of the interest declared and the completeness of the submission. In some cases the Belastingdienst requires the subject entity's cooperation. The Standard and Extended tiers cover this procedure where it is accessible under standard rules.

What does the extract show about outstanding tax liabilities? The Belastingdienst does not confirm outstanding liabilities to third parties under standard procedures. The extract establishes filing compliance — whether returns have been submitted on schedule. It does not establish whether assessments have been raised, whether payments are overdue, or whether the entity is under audit. That ceiling is stated before payment.

How long does the KVK extract remain valid? The KVK extract is timestamped at issuance. It reflects the register at that moment. There is no statutory validity period for third-party use; the extract ages from the moment of issuance. For due diligence purposes, a fresh extract is obtained at the time of the transaction.

Is the BTW-nummer the same as the RSIN? No. The RSIN is the internal identifier assigned by the KVK at incorporation. The BTW-nummer is issued by the Belastingdienst for VAT purposes and is derived from the RSIN but carries a different format. Both appear in the KVK Handelsregister extract. VIES validates only the BTW-nummer.
