Obtaining land and title register extract in Ireland

Ireland operates a state-guaranteed title register. The registered owner, the title boundary, and every charge or burden on the title are recorded in a single folio. Control over a property — who holds it, who can encumber it, and who can transfer it — is visible from that folio and from no other source.

The folio does not show who instructed the purchase, who funded the acquisition, or who benefits economically from the asset. Those questions sit outside the register. The register answers one question precisely: who is the legal owner of record, and under what encumbrances.

What the folio contains

A Land Registry folio is divided into three parts.

Part A identifies the property: folio number, county, and a reference to the filed map. The filed map defines the title boundary. Discrepancies between the filed map and physical occupation are not resolved by the folio.

Part B names the registered owner. For a company, the registered name and number appear. For an individual, the name appears without date of birth or address. The folio does not distinguish between a sole owner, joint tenants, and tenants in common unless the ownership structure was registered at the time of transfer.

Part C records burdens: mortgages, charges, rights of way, covenants, and other encumbrances. Each burden carries a registration date. A burden registered after the acquisition date indicates a post-purchase encumbrance.

The folio is the authoritative record. A vendor cannot transfer a clean title over a registered burden without discharging it first.

The register is public — what the service covers

This register is public and free of charge. What the service covers is the removed path: folio identification from address or description, retrieval of the correct folio and filed map, language and format preparation, and delivery of a structured extract with source attribution.

Identifying the correct folio from a property address requires matching the address against the Land Registry index. Ireland does not operate a single address-to-folio lookup accessible without registration. Multiple folios can attach to a single address where a property has been subdivided. A folio search without the correct folio number returns no result — it does not confirm absence of registration.

The filed map is a separate document from the folio. It is retrieved independently. A folio extract without the filed map does not show the title boundary.

Registry of Deeds: unregistered title

Approximately 7% of land in Ireland remains unregistered. For unregistered title, the chain of ownership is established through deeds held in the Registry of Deeds. The Registry of Deeds records the existence of a deed, not its full content. Establishing title from the Registry of Deeds requires retrieval and review of the underlying deeds.

An address search that returns no Land Registry folio does not confirm that the property is unregistered. It may indicate an incorrect folio reference, a recently registered title not yet indexed, or a property held under a different description.

Control: what the folio establishes and what it does not

The folio establishes legal ownership of record. In a cross-border verification context, this answers the question of who can legally transfer, charge, or encumber the asset.

The folio does not establish:

  • Whether the registered owner holds the property on trust for another party
  • Whether a beneficial interest has been created by contract or conduct
  • Whether the registered owner is controlled by another entity
  • Whether the acquisition was funded by a third party

These questions require sources outside the Land Registry: company registers, court records, and contractual documentation. The folio is the starting point for a title chain, not its conclusion.

Timeline and delivery

The PRAI processes folio requests through its online portal, landdirect.ie. Retrieval of a folio and filed map is typically completed within one working day once the correct folio reference is identified. Address-to-folio matching adds time where the folio reference is not known in advance.

Certified copies of folio documents carry an official seal. Uncertified copies are sufficient for most due diligence purposes. The distinction between certified and uncertified copies affects admissibility in proceedings, not the factual content of the folio.

The limit of what the sources allow

The Land Registry folio shows legal ownership as registered. It does not show beneficial ownership, trust arrangements, or the economic interest behind the registered title.

Where the registered owner is a company, the folio names the company. It does not name the company's shareholders, directors, or ultimate beneficial owners. Those records are held in the Companies Registration Office (CRO), not the Land Registry.

Where the registered owner is an individual, the folio names the individual. It does not show whether that individual holds the property on behalf of another party.

A folio free of burdens in Part C does not confirm that no informal security arrangement exists. Equitable mortgages and deposit of title deeds — instruments used before compulsory registration — may not appear on the folio if they predate registration.

The filed map defines the boundary as registered. It does not resolve boundary disputes or confirm physical occupation. Discrepancies between the filed map and the physical boundary require a surveyor's report, not a registry extract.

Approximately 7% of Irish land remains outside the Land Registry. For that portion, the folio search returns no result. This is not confirmation of absence of ownership — it is confirmation that title has not been registered.

FAQ

Does a clean folio confirm that the property is unencumbered? A folio with no entries in Part C shows no registered burdens. It does not confirm the absence of unregistered equitable interests, informal security arrangements, or rights arising by operation of law. The folio records what has been registered, not every interest that may affect the title.

Can a folio be retrieved without knowing the folio number? Yes. The PRAI index can be searched by county and address. Where an address corresponds to multiple folios — for example, where a building has been subdivided — each folio must be retrieved separately. Address-to-folio matching is part of the retrieval process, not a separate search.

Does the folio show the purchase price? No. The Land Registry does not record the consideration paid on transfer. Stamp duty returns filed with Revenue contain the declared consideration, but those returns are not part of the Land Registry record and are not publicly accessible.

What if the property is not found in the Land Registry? Approximately 7% of Irish land remains unregistered. A negative Land Registry result requires a Registry of Deeds search to establish whether title has been recorded there. A negative result in both registers does not confirm absence of ownership — it confirms absence of registration.

Is the folio extract admissible as evidence? An uncertified copy is sufficient for due diligence and verification purposes. A certified copy, bearing the PRAI seal, is required for use in legal proceedings. Certification is available on request and is noted in the Standard and Extended tiers.
